Terms of Service

01Acceptance & Eligibility

By reserving, purchasing, accessing, or using the Digiyee device and its associated services, you agree to these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) to reserve, purchase, or operate a Digiyee device. If you are using Digiyee on behalf of a company, you represent that you are authorized to accept these Terms on its behalf.

02Description of Service

Digiyee is a pre-configured hardware device — a desktop compute appliance — that runs a local agent stack and a preloaded workflow library. The device executes five operational duties on-device: customer lead handling, request triage, corporate email processing, ops data aggregation, and marketing/advertising deployment. It integrates with your existing stack (Gmail, HubSpot, Salesforce, Shopify, Slack, Google Ads, Meta Ads, Calendly, and others) via OAuth. Optional cloud-assisted processing may be enabled for specific heavy tasks at your discretion.

03Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for the OAuth tokens and API keys stored on your device for connected services. You agree to provide accurate information and to notify us immediately of any unauthorized access to your account or device.

04License Grant & Restrictions

We grant you a limited, non-exclusive, non-transferable license to use the Digiyee firmware, agent software, and workflow library on your purchased device. You may not:

Open-source components included on the device are governed by their respective license terms, available at the Open Source page.

05AI Service Disclaimers

AI outputs are non-deterministic. Digiyee may produce inaccurate, incomplete, or inappropriate responses. You are responsible for reviewing and verifying all AI-generated content — including drafted emails, qualified leads, ops summaries, and ad campaigns — before acting on or publishing it.

Digiyee is not a substitute for professional medical, legal, financial, or other expert advice. Do not rely on agent outputs for decisions that require professional judgment.

We do not guarantee the accuracy, reliability, or availability of any AI model — local or cloud-assisted. Model capabilities may change as the workflow library updates or third-party providers update their services.

Digiyee's approval-gate and audit-log features are provided to support your review of agent actions. You remain responsible for configuring those gates appropriately for your business, regulatory environment, and risk tolerance.

06User Content & Data

You retain full ownership of all content you create, store, or process on your Digiyee device — including customer emails, leads, CRM records, ops data, audit logs, and workflow customizations. We do not access, collect, or claim any rights to your on-device data.

When you voluntarily submit feedback, feature requests, or bug reports to us, you grant us a non-exclusive, royalty-free license to use that feedback for product improvement.

08Third-Party Services & Integrations

Digiyee connects to third-party services you authorize (Gmail, HubSpot, Salesforce, Shopify, Slack, Google Ads, Meta Ads, Calendly, and others). These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services. You are responsible for complying with their terms when using their APIs through Digiyee, including advertising policies, acceptable-use policies, and rate limits.

If you enable optional cloud-assisted processing, the selected provider's terms (Anthropic, OpenAI, Google, or others) apply to that traffic.

09Intellectual Property

The Digiyee name, brand, hardware design, firmware (excluding open-source components), preloaded workflow library, and documentation are the intellectual property of Digiyee Labs LLC. These Terms do not grant you any rights to our trademarks, trade dress, or proprietary technology beyond the limited license in Section 4.

10Pricing & Billing

Hardware: One-time purchase at the listed price. Pre-launch reservations lock in a discount of $50 off the launch price. No recurring subscription fees are required for the base device and its preloaded workflow library.

Workflow library updates: Included for the life of the device. We may offer optional vertical playbook packs or advanced workflow add-ons in the future; any such offering, and its pricing, will be presented to you at the time it becomes available and will require your explicit opt-in.

Optional cloud-assisted processing: If you enable cloud routing, you may be responsible for the cost of the selected third-party provider's API charges. We may offer a managed cloud routing service with its own pricing; any such service will be optional and disclosed at the time of enrollment.

11Warranty Disclaimer

The Digiyee software, firmware, workflow library, and agent services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Hardware warranty is governed separately by the Limited Hardware Warranty below.

12Limited Hardware Warranty

Digiyee Labs LLC warrants the Digiyee hardware device against manufacturing defects for one (1) year from the date of delivery. Extended warranty plans may be available at purchase.

Covered: Defects in materials and workmanship under normal use.

Not covered:

Remedy: At our discretion, we will repair or replace the defective unit. Next-day replacement available across the continental United States. Contact support@digiyee.xyz to initiate a warranty claim.

13Reservations, Returns & Refunds

Reservations are subject to product availability. Either party — you or Digiyee Labs LLC — may cancel a reservation at any time before the product ships, for any reason or no reason, with a full refund of the amount paid.

Reservation Terms:

Post-Delivery Returns:

30-day money-back guarantee. If Digiyee doesn't pay for itself through captured leads, drafted email, or ops output in your first 30 days, return the device for a full refund. The device must be in original condition with all included accessories. We cover return shipping within the continental United States.

EU/UK customers: You have a statutory 14-day right of withdrawal from the date of delivery, in addition to our 30-day guarantee.

Refund method: All refunds are issued to the original payment method within 7–10 business days of cancellation (reservations) or receipt of returned device (post-delivery returns).

14Limitation of Liability

To the maximum extent permitted by law, Digiyee Labs LLC's total liability for any claim arising from or related to the device or services is limited to the amount you paid for the device.

We are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, lost business opportunities, misdirected leads, mis-sent emails, or ad-spend overruns — even if we were advised of the possibility.

This limitation applies to claims based on warranty, contract, tort, or any other legal theory.

15Indemnification

You agree to indemnify and hold harmless Digiyee Labs LLC from any claims, damages, or expenses arising from your use of the device, your violation of these Terms, or your violation of any third-party rights (including the terms of connected services, advertising platforms, and applicable laws on unsolicited communications).

16Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising from these Terms will be resolved through binding arbitration administered by JAMS, conducted individually (not as a class action). You may opt out of arbitration by notifying us in writing within 30 days of your purchase.

Class action waiver: You agree to resolve disputes individually and waive any right to participate in class-action lawsuits or class-wide arbitration.

17Export Controls

The Digiyee device and software may be subject to U.S. export control laws (EAR). You agree not to export, re-export, or transfer the device to any country, entity, or person prohibited by applicable export laws.

18Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email and posted on our website at least 30 days before taking effect. Continued use of the device or services after changes take effect constitutes acceptance.
